Since the story is your property and we want to protect it we need to have some kind of agreement to give you security and as well us. Since we know legal stuff is boring to read we will explain each paragraph before id its to complicated. But legally binding is the stuff that is not in italic! 

This Agreement provides the terms and conditions of your participation in the Star Pig Author program (the "Program") and your distribution of digital content through the Program.

Agreement Acceptance. You accept this Agreement and agree to be bound by its terms as soon as you submit a story to us.

We have the right to terminate this Program at any time without further notice. 

  • We "pay" you for every story you are allowing us to publish, therefore we need you to open a "retail" account. With this account, you can use the PigBucks to buy items inside our online store. You will not be able to convert any PigBucks into Cash at any time!

Eligibility. You must have an active PigLoad account to receive PigBucks. You represent that you are at least 18 years old (or the age of majority where you reside, whichever is older) and that you can form a legally binding contract.

  • The following means if someone has access to your account and spends the BigBucks we can't be held accountable for that action at all. 

You are solely responsible for safeguarding and maintaining the confidentiality of your account username and password and are responsible for all activities that occur under your account, whether or not you have authorized the activities. 

  • For better reading or formatting, we are allowed to edit your story.

We are entitled to remove or modify the story for better reading or formatting issues. You may not include in any story any advertisements or other content that is primarily intended to advertise or promote products or services of others. We may, in our discretion, reformat your story, and you acknowledge that unintentional errors may occur in the process of reformatting of that. We may also, in our discretion, correct any errors existing in a story.

We are entitled to determine what content we accept and distribute through the Program in our sole discretion. 

  • if you don't want your story published on our side any longer simply send us a mail. If the story is older then 30 days you even can keep the PigBucks!

You may withdraw your story from our side at any time by simply emailing us to do so. We might not be able to delete or withdraw our social media mention of your story. 

  • We will promote your story in all our forms like newsletter and social media, therefore we mostly only will use parts of the story.

We will have sole discretion in determining all marketing and promotions related to the story and may, without limitation, market and promote your story by making chapters or portions of it available on our channels. 

When We "Pay" You. Unless otherwise specified we will grant your account 50 PigBucks - after 30 days your story goes online on our side. We pay you a reminder of 1 PigBuck on the day of publishing and the remaining amount after 30 days. If you withdraw the story in the timeframe of 30 days after the first day of publishing we will not pay the remainder of the payment. At the time of payment, we will make available to you an online report in your account detailing the name of the story for easier understanding. We will not owe you any fees for any marketing or promotional efforts. You acknowledge that we have no obligation to market, distribute your story at all. 

  • Since the story is your property and you own it you must allow us to publish it.

Grant of Rights. You grant us by Schweinkram Inc., throughout the term of this Agreement, a nonexclusive, irrevocable, right and license to distribute your story.

This right includes, without limitation, the right to: (a) reproduce, index and store the story on one or more computer facilities, reformat, convert and encode electronic media; (b) display, market, transmit, sell, distribute, and otherwise make available all or any portion of through our media outlets.

  • We need to make sure that you are the owner of the story and it is not simply copy-pasted from somebody else since that would be illegal

Representations, Warranties, and Indemnities. You represent and warrant that: (a) you have the full right, power and authority to enter into and fully perform this Agreement and will comply with the terms of this Agreement; (b) prior to your delivery of any content, you will have obtained all rights that are necessary for the exercise the rights granted under this Agreement; (c) neither the exercise of the rights authorized under this Agreement nor any materials embodied in the content nor its sale or distribution as authorized in this Agreement will violate or infringe upon the intellectual property, proprietary or other rights of any person or entity, including, without limitation, contractual rights, copyrights, trademarks, common law rights, rights of publicity, or privacy, or moral rights, or contain defamatory material or violate any laws or regulations of any jurisdiction; (d) you will ensure that all stories delivered under the Program comply with the law; (e) you will be solely responsible for accounting and paying any co-owners or co-administrators of any story or portion thereof any royalties with respect to the uses of the content and their respective shares, if any and (f) you will not attempt to exploit the PigLoad by Schweinkram Inc.. To the fullest extent permitted by applicable law, you will indemnify, defend and hold, its officers, directors, employees, affiliates, subcontractors and assigns harmless from and against any loss, claim, liability, damage, action or cause of action (including reasonable attorneys' fees) that arises from any breach of your representations, warranties or obligations outlined in this Agreement. We will be entitled, at our expense, to participate in the defense and settlement of the claim or action with counsel of our choosing. 

  • And if the story is not an original and we been sued we must make sure that we don't have to pay for it, since we have been given wrong statements from you and we must make sure that you know you would have to pay for this and all expenses that came along with it.

Rights Clearances You will obtain and pay for any necessary clearances and licenses for the stories to permit our exercise of the rights granted under this Agreement without any further payment obligation by us, including, without limitation, all royalties and other income due to any copyright owner.  

Disputes. Any dispute or claim relating in any way to this Agreement will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
